1. Acceptance of Terms

By accessing and using Scratch by KubeBento ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Scratch provides temporary Kubernetes cluster environments accessible through web browsers. The Service allows users to create ephemeral Kubernetes sessions for testing, development, and experimentation purposes.

3. Account Terms

  • You must be 13 years or older to use this Service.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account and password.
  • You are responsible for all activities that occur under your account.
  • One person or legal entity may not maintain more than one free account.

4. Account Termination

KubeBento reserves the right to suspend or terminate your account and access to the Service, with or without cause, with or without notice, effective immediately, and without refund. This includes, but is not limited to:

  • Violation of these Terms and Conditions
  • Abuse of Service resources or infrastructure
  • Illegal or harmful activities
  • Non-payment of fees
  • Violation of intellectual property rights
  • Any conduct that KubeBento deems inappropriate or harmful to the Service or other users

Upon termination, your right to use the Service will cease immediately, and any data in active sessions will be permanently lost.

5. Service Usage and Limitations

  • Sessions are temporary and ephemeral. All data within sessions is automatically deleted upon session termination.
  • CPU, memory, and storage allocations are limited based on your subscription tier.
  • Session duration limits apply based on your subscription tier.
  • You may not use the Service for illegal activities, cryptocurrency mining, or any activities that violate applicable laws.
  • You may not attempt to circumvent resource limitations or security measures.

6. Data and Privacy

  • KubeBento does not store, backup, or retain any data created within Kubernetes sessions.
  • All session data is ephemeral and permanently deleted when sessions end.
  • KubeBento collects only usage metrics including: session count, duration, CPU usage, memory usage, and storage usage.
  • You are solely responsible for backing up any important data before session termination.
  • KubeBento is not responsible for any data loss or corruption.

7. Payment and Refunds

  • Subscription fees are billed in advance on a monthly basis.
  • All fees are non-refundable except as specifically provided in these terms.
  • Refunds may be provided at KubeBento's sole discretion based on actual usage of Service resources.
  • Refund calculations, if provided, will be based on unused session allocations and actual resource consumption.
  • No refunds will be provided for terminated accounts due to Terms violations.
  • Subscription downgrades will take effect at the next billing cycle.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KUBEBENTO SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, files, or work product
  • Loss of profits, revenue, or business opportunities
  • Business interruption or downtime
  • Unauthorized access to or alteration of your transmissions or data
  • Service interruptions or outages
  • Errors, mistakes, or inaccuracies in the Service
  • Personal injury or property damage resulting from Service use

IN NO EVENT SHALL KUBEBENTO'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO KUBEBENTO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Service Availability

  • KubeBento strives to maintain Service availability but does not guarantee uninterrupted access.
  • Scheduled maintenance may result in temporary Service unavailability.
  • KubeBento is not liable for any downtime or service interruptions.
  • No SLA credits or compensation will be provided for service unavailability.

10. Intellectual Property

  • The Service and its original content, features, and functionality are owned by KubeBento.
  • You retain ownership of any code or content you create within sessions.
  • You grant KubeBento a license to provide the Service and collect usage metrics.

11. Prohibited Uses

You may not use the Service:

  • For any unlawful purpose or to solicit others to unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • For cryptocurrency mining or similar resource-intensive computations
  • To transmit, or procure the sending of, any advertising or promotional material, including "junk mail," "chain letters," "spam," or similar solicitations

12. Changes to Terms

KubeBento reserves the right to modify these terms at any time. Users will be notified of material changes via email or Service notifications. Continued use of the Service after changes constitutes acceptance of new terms.

13. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which KubeBento operates, without regard to conflict of law provisions.
